General Terms and Conditions (GTC)

The terms "we", "us", and "our" refer to HOBBYBASE VIENNA. We operate this online shop and website to provide you with a personalized shopping experience. Our shop is based on the Shopify e-commerce platform.

The following General Terms and Conditions (GTC) describe your rights and obligations when using our services. Please read them carefully. By visiting our website or making a purchase, you agree to these GTC and our Privacy Policy.

SECTION 1 – ACCESS AND ACCOUNT

By agreeing to these GTC, you declare that you are of legal age in your country of residence. For purchases, you will be asked to provide current, complete, and accurate billing and shipping information. You are solely responsible for the security of your account login credentials. Transferring your account to third parties is not permitted.

SECTION 2 – OUR PRODUCTS

We strive to display our products (including colors and details) as accurately as possible. However, we cannot guarantee that the color representation on your screen will exactly match reality. We reserve the right to remove products from our range at any time or to limit the quantities sold per person, household, or order. All product descriptions may be changed at any time without prior notice.

SECTION 3 – ORDERS AND CONCLUSION OF CONTRACT

The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding online catalog. By clicking the order button, you submit a binding offer to purchase. The purchase contract is only concluded when we accept your order by sending an order confirmation via email or by shipping the goods to you. The return or exchange of purchases is subject to our separate cancellation policy.

SECTION 4 – PRICES AND INVOICING

All stated prices include statutory VAT and do not include applicable shipping costs. Prices may change without prior notice. The price at the time of purchase applies to your order. You agree to provide current and accurate payment information for all purchases and confirm that you are authorized to use the chosen payment method.

SECTION 5 – SHIPPING AND DELIVERY

All stated delivery times are estimates. We are not liable for delays caused by the shipping service provider, customs clearance, or force majeure. For consumers, the risk of accidental loss or deterioration of the goods passes to you upon delivery of the goods.

SECTION 6 – INTELLECTUAL PROPERTY

Our website and all text, images, graphics, logos, and designs contained therein are the property of HOBBYBASE VIENNA or our licensors and are protected by Austrian and international copyright and trademark law. Use for commercial purposes, reproduction, or distribution without our express written consent is prohibited.

SECTION 7 – OPTIONAL TOOLS & THIRD-PARTY PROVIDERS

We may provide access to third-party tools that we neither monitor nor control. The use of these tools is at your own risk and subject to the terms of the respective third-party providers. We are not liable for damages arising from the use of third-party websites or services, even if they are accessible via links in our shop.

SECTION 8 – RELATIONSHIP WITH SHOPIFY

Our shop is hosted by Shopify Inc. However, contracts for the purchase of goods are concluded exclusively between you and HOBBYBASE VIENNA. Shopify is not responsible for aspects of the business between you and us.

SECTION 9 – FEEDBACK AND USER COMMENTS

If you submit ideas, suggestions, or reviews (collectively "Feedback") to us, you grant us the right to use, edit, and publish this Feedback at any time without restriction. We are not obliged to treat Feedback confidentially or to remunerate it. You assure that your Feedback does not infringe the rights of third parties and does not contain any unlawful or offensive content.

SECTION 10 – ERRORS AND INACCURACIES

It may happen that information on our website contains typographical errors or omissions regarding product descriptions, prices, shipping costs, or availability. We reserve the right to correct these errors at any time (even after receipt of an order) or to cancel orders if information was inaccurate.

SECTION 11 – PROHIBITED USES

The use of the website is prohibited for the following purposes: (a) for unlawful purposes; (b) to infringe intellectual property rights; (c) to harass or discriminate against persons; (d) to transmit viruses or malware; (e) to collect personal data of others (phishing, scraping). In case of violations, we reserve the right to block your account.

SECTION 12 – WARRANTY

For the items offered in our shop, the statutory warranty rights apply in accordance with Austrian law. Deviating, US-typical disclaimers (such as "as is") do not apply to consumers in the European Economic Area.

SECTION 13 – LIMITATION OF LIABILITY

HOBBYBASE VIENNA is liable without limitation for intent and gross negligence, as well as for damages resulting from injury to life, body, or health. For slight negligence, we are only liable for the breach of essential contractual obligations (cardinal obligations) whose fulfillment is essential for the proper execution of the contract. In this case, liability is limited to the foreseeable, typical damage for the contract. Further liability is excluded.

SECTION 14 – APPLICABLE LAW AND JURISDICTION

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection provisions of the country in which you have your habitual residence remain unaffected by this choice of law. For contracts with merchants or legal entities, the exclusive place of jurisdiction is Vienna, Austria.

SECTION 15 – CHANGES TO THE GTC

We reserve the right to update these GTC at any time. The current version can be viewed on this page. For significant changes, we will inform you in accordance with legal provisions.

SECTION 16 – ONLINE DISPUTE RESOLUTION (ODR)

The European Commission provides a platform for online dispute resolution (ODR), which you can find here: https://ec.europa.eu/consumers/odr/. We are not obliged and generally not willing to participate in dispute resolution proceedings before a consumer arbitration board.
